Mining Laws

  • Advising on compliance of all facets of Mining Law subject to a variety of national and state-specific regulations which includes Mines and Minerals (Development and Regulation) Act, 1957 (MMDR Act); Mineral Conservation and Development Rules, 1988; West Bengal Minor Minerals Rules, 2002; Mines Act, 1952; transfer and assignment of mining rights in accordance with state regulations; royalty agreements and revenue-sharing arrangements with state authorities, land use agreements and zoning laws related to the construction and operation of mining infrastructure; CSR compliance and ensuring the effective implementation of community welfare programs; securing sub-surface and surface rights for mineral extraction; tribal land rights and forest rights under the Forest Rights Act, 2006 and land acquisition under the Land Acquisition Act, 2013; etcetera.

  • Obtaining and renewing Mining Leases, Prospecting Licenses, Environmental Impact Assessment,  Environmental Clearance Applications; Forest Clearances; advising on the drafting and negotiating contracts for mining infrastructure development including transportation routes, equipment procurement and construction services, Mine Closure Plans and guiding the reclamation of mined land, employment contracts and advising on employee welfare and compensation issues; ensuring health and safety standards and other industry-specific guidelines. 

  • Resolving contractual disputes between mining companies, contractors, and suppliers; labor disputes, including worker safety violations, unfair dismissal claims, and disputes related to collective bargaining agreements; Representing clients in land acquisition proceedings and ensuring fair compensation for landowners under applicable laws; National Green Tribunal (NGT) cases, particularly those concerning environmental violations and public interest litigation (PIL); regulatory enforcement actions, including violations of environmental laws and royalty-related conflicts; mining-related litigation before civil courts, environmental tribunals and arbitration tribunals; disputes over mineral rights, ownership, and compensation.
